Are Subliminal Messages Actually Illegal?
Recently there has been a lot of controversy over subliminal messages in the media. Over the last 2-3 years then have gained a lot of news coverage.
McDonalds were high profile a couple of years ago when they were caught flashing an advert for a split second during a cooking program on the Food Network. Shortly after
George Bush was caught using subliminal messages during his re-election campaign and speeches. These instances caused public outcry at the time, but sadly little was done. George Bush simply ignored the allegations and eventually they went away, and the Food Network and McDonalds claimed it was just a programming error rather than a deliberate subliminal message.
No further investigation ever pursued either Bush or McDonalds – sadly.
I think there should be more done to monitor and control the use of subliminal messages and how they are used, but back to the original question: Simply put, no they aren’t illegal. They are banned from use within advertising in the way that you can’t use pure subliminal sounds, or flashing subliminal images or text. But things get a little more complicated when considering a “subliminal suggestion”..
A subliminal suggestion is usually an image which with just a passing glance you wouldn’t notice anything, but on further investigation there is a subliminal link – typically linking a product to sex within the buyers mind. This could be something as simple as having a sexy girl smiling and using the product, or it could be more subtle such as incorporating the female form into a logo / product design – Coca Cola often use this female imagery subliminal technique..

Subliminal Messages – If You Watch TV You’re Bombarded With Them Every Day
When you think of subliminal messages, your mind probably thinks of something that’s completely hidden. Maybe like the rumours of satanic messages if you played certain records backwards. But actually the dictionary definition of subliminal is something that is “below the threshold of conscious perception” which gives a much wider remit and is why television hits you over the head with subliminal messages all the time.
One of the reasons that it is so successful at doing this is that television is a very complex medium.
So whilst your main focus could be on the lead character on the show or the anchorman on the news, there’s lots more happening.
Let’s take a television news show and see where they could hit you with a bunch of subliminal messages:
- The presenter’s clothing – what we wear can define us, so a smartly dressed presenter will affect us differently from one in a war zone, dressed in combat clothing
- The tickertape subtitles that constantly scroll across the screen. You don’t consciously read these but they are carefully edited to give you the channel’s slant on the main events of the day. Different colors may be used as well.
- The pictures for the news story. Again, these will be carefully selected and edited to present the story in precisely the right way.
- Everything else that is going on in the studio. From the reporters casually wandering around in the background to the formality of the set, the lighting used and of course the news scripts themselves.
Just watch the news on two different channels to see how what should be exactly the same message is presented in a subliminally different way.
Product placement is another place that subliminal messages can be used to hit you on television.
How many times do you see people using Apple computers versus other makes? Chances are that this is a lot more than real life, where Macs are maybe 10% of the laptops in use. On television it seems like a 50/50 chance that the laptop in use will be an Apple rather than a Windows machine. A subtle, subliminal way to hit you with the idea that Apples are in some way superior to other computers. Adding support to what your Apple carrying friends have already told you is the absolute truth.
The cars that are driven in TV shows are another subliminal message. It cost Ford and Hyundai a lot of money to make sure that Jack and the other good guys drove their vehicles. Regardless of how conscious you were of this, the models used by the heroes will slip through into your brain.
And it’s not beyond the wits of television to allow negative product placement either, so you’ll probably make a mental note of the soft drink being supped by the baddies as well as the goodies.
You can’t tune out the subliminal messages that television bombards you with. There are just too many of them for us to be able to do that. But you can maybe prepare yourself and make yourself more open by studying how subliminal messages work and building up your own – subconscious – protective force field.
